TERMS OF USE – XSPORTY

1. General Information
These Terms of Use govern access to and use of the XSPORTY digital platform, operated by XSPORTY LLC ("XSPORTY," "we," or "our"), a company registered in Puerto Rico with its principal office in San Juan. For inquiries: admin@xsporty.com
2. Acceptance and Eligibility
By clicking "CREATE ACCOUNT" or using the platform, you accept this agreement and confirm that you are at least 18 years old.
3. User Registration and Obligations
• Provide accurate, up-to-date information. • Protect your login credentials and report unauthorized use.
4. Intellectual Property
You retain ownership of your content. By using XSPORTY, you grant us a worldwide, non-exclusive, revocable, royalty-free, and limited license to operate and promote the platform.
5. Zero-Tolerance Policy
We do not tolerate any content or conduct that is: • Illegal, violent, discriminatory, harassing, or hateful • Pornographic or exploitative of minors • Infringing on third-party rights Violations may result in permanent suspension or legal reporting.
5.1 Prohibited Content and Actions
• Spam, phishing, or fraud • Malware or scraping • Publishing others' personal data without consent • Sexually explicit images or images of minors
6. Reporting, Blocking, and Moderation
• Every profile, post, and chat includes a "Report" button. • You may block users to prevent contact. • We review all reports within 24 hours. • Automated filters flag offensive content for manual review.
7. Event Availability and Cancellations
XSPORTY may cancel activities due to force majeure with timely notice.
8. Intermediation and Risks
XSPORTY acts only as a neutral facilitator. Participation in sports activities carries risks, including injury or death. We are not liable for damages or conflicts between participants.
9. Limitation of Liability
Services are provided "as is." Our total liability is limited to $100 or the total amount you paid in the last 12 months, whichever is greater.
11. Account Termination
11.1 User-Initiated Deletion Delete your account in-app via Settings → Account → Delete Account. After confirmation, access is revoked, and your data is erased or anonymized (except logs retained for 30 days for fraud prevention/legal defense). 11.2 Grounds for Suspension or Termination We may suspend or terminate your account without notice for: • Breaching these Terms or our Zero-Tolerance Policy • Government requests • Voluntary deletion • Service discontinuation • Security or technical issues • Inactivity over 24 months • Non-payment of dues 11.3 Effects of Termination • Access revoked • Content and data deleted or anonymized • Possible future registration block 11.4 Right of Appeal You may appeal suspensions by emailing admin@xsporty.com within 7 days. We will respond within 72 hours. 11.5 Disclaimer Suspension or termination is at our sole discretion.
12. Dispute Resolution and Arbitration
All disputes shall be resolved by arbitration through the AAA in San Juan, Puerto Rico. You may opt out within 30 days of account creation by emailing admin@xsporty.com.
13. Governing Law
These Terms are governed by the laws of Puerto Rico and the U.S. Jurisdiction: San Juan, Puerto Rico.
14. Amendments
We may update these Terms at any time. You will be notified via email or in-app banner at least 10 days before major changes. Continued use indicates acceptance.
15. General Provisions
• No partnership or agency relationship is created. • You may not assign these Terms without our consent. • We may assign or delegate at any time. • If a clause is ruled invalid, the rest remain effective. • Notices may be delivered electronically.
